1. Agreement to Terms
By purchasing, accessing, or using the Come Alive 30-Day Program (the "Program"), offered by Kylie Johnson ("we," "us," "our"), you ("you," "participant") agree to be bound by these terms (the "Terms"). If you do not agree, do not purchase or use the Program.
2. Eligibility
You must be at least 18 years old to purchase or participate in the Program. By purchasing, you represent that you meet this requirement.
3. Description of the Program
The Program is a 30-day digital course consisting of written lessons, guided audio recordings (including breathwork, meditation, and gratitude practices), journaling prompts, and suggested daily actions, delivered online. The Program is educational and experiential in nature and is not a substitute for medical, psychological, or professional advice.
4. Purchase and Access
4.1 Price and Payment. The Program is available for a one-time payment, at the price displayed at checkout, processed securely through Stripe. We do not store your payment card details.
4.2 Access. Upon successful payment, you will receive access to the Program for as long as the Program remains available and offered by us. This is not a guarantee of permanent or lifetime access. We reserve the right to modify, suspend, or discontinue the Program at any time.
4.3 Account. Access is personal to you. You agree not to share your login credentials or resell, redistribute, or provide access to the Program to any third party.
5. Refund Policy
All purchases are final. Because access to Program content is granted immediately upon payment, we do not offer refunds, in whole or in part, except where required by applicable law.
6. Health and Safety Disclaimer; Assumption of Risk
6.1 Not Medical Advice. The Program includes breathwork techniques (including but not limited to forceful, rapid breathing techniques such as Kapalabhati, extended breath retention, and other pranayama-style practices), cold exposure exercises, and physical movement. This content is educational and wellness-oriented only. It is not medical advice, and it is not a substitute for consultation with, diagnosis by, or treatment from a qualified physician or mental health professional.
6.2 Consult a Physician. Certain breathwork and physical practices in the Program are not appropriate for everyone. You should consult a physician before beginning the Program, particularly if you are pregnant or trying to become pregnant, have any cardiovascular condition (including high or low blood pressure), have epilepsy or a history of seizures, have a respiratory condition (including asthma), have a psychiatric condition (including panic disorder or a history of trauma), have glaucoma, have had recent surgery, or are otherwise unsure whether these practices are safe for you.
6.3 Your Responsibility. You are solely responsible for evaluating your own physical and mental fitness to participate in any exercise, technique, or practice included in the Program. Stop any practice immediately and seek medical attention if you experience dizziness, chest pain, shortness of breath, fainting, or any other concerning symptom.
6.4 Assumption of Risk. You voluntarily and knowingly assume all risks associated with your participation in the Program, known and unknown, including the risk of physical injury, and you agree that we are not responsible for any injury, harm, or loss arising from your participation.
7. Limitation of Liability
To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, regarding the Program, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the Program. Our total liability to you for any claim arising from these Terms or the Program will not exceed the amount you paid for the Program.
8. Intellectual Property
All content in the Program, including text, audio recordings, and other materials, is owned by us and is provided for your personal, non-commercial use only. You may not copy, reproduce, distribute, publicly perform, or create derivative works from the Program content without our prior written consent.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Program after changes are posted constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
